Scope: Subject eDiscovery & Forensic Examination

 

The difference between the scope of this type case and a standard Forensic Examination of Electronic Storage Device is the depth of the case. A standard examination will be conducted, for example, when a client needs to "examine this device" - as opposed to a subject specific discovery and examination where a client may ask to "examine all electronic storage devices that may contain evidence of improper or unlawful activity on the company network." In both cases procedures are followed that will produce legally admissible data as evidence in a court of law, whether it is used or not. The latter example, however, includes an investigative element that implies further research: What all devices fall within the scope of the request? What people/employees may be involved? What type of data is relivant? Are there extenuating circumstances that would affect the completeness of the investigation? etc...

When to request a Subject eDiscovery & Forensic Examination:
